"A Council of brave men: an empirical analysis of employment tribunals".

If we concentrate our attention to the law and economics field, we notice, at first glance, a certain plausible appeal between economics and other disciplines related to different human actions and sectors of society: in fact, our researches' focus and attention could be very broad, ranging from crime to terrorism, through - inter alia - education, family, insurance, labor and even fertility. This commendable extension of economic horizons to other disciplines guarantees a flexible approach, allows the coordination of answers to complex matters and leads to rapid reactions to current challenges. The law and economics literature relies notably on this very broad view, according to which we gave the foundation for new approaches, inspiring not only the further literature on the subjects, but also scholars to discuss real-world problems that go beyond a mere market behavior and decision analysis. In view of the foregoing, it is extremely interesting to proceed with an approach that is not merely legal and apodictic to the analysis of national jurisdictions. The aim of the present thesis is to offer an innovative and revolutionary look at a bicentennial institution - Conseil de prud'hommes - born during the era of Napoleon Bonaparte, in a period of stormy industrial relations, carachterized by the vigorous opposition between employers and workers. The Court has some obvious peculiarities (e.g. a judicial panel composed of an even number of members; non-professional judges elected among the ranks of the labor world; a very slow biphasic procedure, ...) and leaves space for numerous interpretations at the doctrinal and jurisprudential level. What has not yet been fully clarified is the economic sustainability of a real ballast of the system, particularly slow and inefficient, if we calculate the number of reversals of judgments on appeal. By making careful use of econometric techniques, it is therefore possible to analyze from a different perspective the roots of trade unions and judges and understand this institution in depth, in the hope of being able to contribute to the current policymaking debate on how to reform this institution to give it new impetus.

La mia ricerca si concentra sul campo dell'analisi economica del diritto, con una prevalente attenzione all'analisi dell'efficienza delle Corti. Attualmente sto procedendo con una analisi empirica delle Corti del lavoro francesi (i.e. Conseil de prud'hommes) e della recente riforma del Presidente in pectore Macron, con un focus importante sui costi benefici. Allo stato attuale, per mezzo di una interessante variabile strumentale (la phylloxéra), è stato possibile argomentare che le precedenti attività dottrinali di indagine dei Prud'hommes erano incomplete e necessitavano di ulteriore approfondimento. Tenuto conto della centralità del dialogo tra le parti sociali innanzi alla corte francese, la possibilità di mettere in relazione la rappresentanza delle parti con i dati sulla conciliazione, ha permesso una analisi delle determinanti di quest'ultima. Il più recente working paper di cui mi sto occupando, invece, procede ad una analisi econometrica dei dati ministeriali relativi alla durata delle procedure, un elemento di forte complessità e di pericolo per la tenuta dei conti francesi, considerate le numerose condanne per violazione dei principi sanciti nell'art. 6 della Convenzione Europea sui diritti dell'uomo. 

My research concentrates its attention in the law and economics domain, with a prevalent focus on the analysis of the efficiency of the Courts. I am currently proceeding with an empirical analysis of the French Labor Courts (i.e. Conseil de prud'hommes) and of the recent reform of the President in pectore Macron, with an important focus on the point of view of benefits and costs. At present, by means of an interesting instrumental variable (the phylloxéra), it has been possible to argue that the previous doctrinal investigative activities on Prud'hommes were incomplete and needed further inquire. Taking into account the centrality of the dialogue between the social partners before the French courts, the possibility of relating the representation of the parties with the data on conciliation, allowed an analysis of the determinants of the latter. Hence, the most recent working paper I'm currently working on proceeds to an econometric analysis of the ministerial data related to the duration of the procedures, an element of great complexity and danger for the keeping of the French accounts, given the numerous convictions for violation of the principles sanctioned in art. 6 of the European Convention on Human Rights.
